Terms of Service

2.1 Acceptance of Terms

By accessing or using the services provided by digitalstorysphere ("we," "our," or "us"), located at Calle de Goya 30, 28001 Madrid, Spain, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2.2 Services Description

digitalstorysphere provides strategic copywriting services including but not limited to: brand messaging architecture, whitepaper production, landing page copywriting, content style guides, SEO content strategy, email sequence copywriting, sales deck scriptwriting, press release and media kit creation, social media content packages, and website copy audits.

2.3 Service Engagement Process

All service engagements begin with a mutual agreement on scope, deliverables, timeline, and pricing. A formal proposal or statement of work (SOW) will be provided before any project commences. Changes to project scope must be agreed upon in writing.

2.4 Payment Terms

Payment terms are specified in each individual proposal or SOW. Standard terms require 50% upfront payment before work begins, with the remaining 50% due upon delivery of final deliverables. Late payments may incur a 1.5% monthly interest charge.

2.5 Intellectual Property

Upon full payment, all intellectual property rights for the final deliverables are transferred to the client. digitalstorysphere retains the right to display work in portfolios and case studies unless otherwise agreed in writing. Draft materials, research notes, and preliminary concepts remain the property of digitalstorysphere.

2.6 Client Responsibilities

The client is responsible for: providing timely access to relevant brand materials and information; reviewing deliverables within agreed review periods; providing clear and constructive feedback; and ensuring that all content provided does not infringe on third-party rights.

2.7 Limitation of Liability

To the maximum extent permitted by law, digitalstorysphere's total liability for any claims arising from or related to our services shall not exceed the total fees paid by the client for the specific service giving rise to the claim. We shall not be liable for any indirect, incidental, or consequential damages.

2.8 Confidentiality

Both parties agree to maintain the confidentiality of any proprietary information shared during the course of the engagement. This obligation survives the termination of the service agreement for a period of two (2) years.

2.9 Termination

Either party may terminate a service agreement with 14 days' written notice. In the event of termination, the client is responsible for payment of all work completed up to the termination date. Digitalstorysphere will deliver all completed work products within 5 business days of termination.

2.10 Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Spain and the European Union. Any disputes shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.

Refund & Reimbursement Policy

If a project is terminated by the client after work has commenced, a partial refund may be issued for work not yet completed. The refund amount will be calculated based on the percentage of the project remaining at the time of termination.

4.4 Non-Refundable Items

  • Work that has been completed and approved by the client.
  • Research and strategy work that forms the basis of subsequent deliverables.
  • Third-party costs incurred on behalf of the client (e.g., stock photography, premium tools).

4.5 Refund Request Process

4.6 Revision Policy

All projects include up to two (2) rounds of revisions as standard. Additional revision rounds may be subject to additional fees, which will be communicated before any additional work commences.

4.7 Dispute Resolution

In the event of a dispute regarding refunds, both parties agree to attempt resolution through good-faith negotiation. If resolution cannot be reached, the dispute shall be submitted to the courts of Madrid, Spain, in accordance with Spanish and EU consumer protection laws.
